Meth addiction led to more trouble for a Traverse City mom
Samantha Hughes, 29, of Traverse City, was already struggling with methamphetamine addiction when she was placed on probation. Her probation terms included wearing an electronic tether. But when Hughes cut off the tether—a clear violation—she landed back in court.
At that time, Hughes was pregnant, and Judge Thomas Power of the 13th Circuit Court was faced with a difficult decision. Concerned for the unborn child’s well-being, he sentenced Hughes to 13 to 24 months in jail—a much longer sentence than usual for a probation violation of this type, but one the judge hoped would keep both mother and baby safe from the consequences of drug use during pregnancy.
A rare win: Overturning the jail sentence
Hughes and her attorney fought the unusually long sentence and ultimately won. She served 352 days—almost a full year—but Judge Power’s original goal was still accomplished: Hughes gave birth to a healthy baby while in jail.
At her resentencing, Hughes promised the court she would “never jeopardize my children or baby due to any drugs.” But soon after her release, tragedy struck again. She was found by another adult in her home, having overdosed, while her infant was left unattended in a pile of laundry. First responders revived Hughes at the scene, but she was charged with misdemeanor fourth degree child abuse.
